Case Summary:

North America Immigration Law Group filed an EB1A (Alien of Extraordinary Ability) petition on behalf of a materials engineer from China. Because our client opted for Premium Processing, the USCIS approved his petition in under two weeks.

Our efforts focused on convincing the USCIS that our client’s work is important to the United States, and that no one with similar skillsets has accomplished what he has. We made clear to the USCIS that our client’s development of oilfield products, as well as the synthesis, characterization, and infrastructural application of industrial byproduct-derived geopolymers improve methods for using and recycling industrial waste products. We also demonstrated how his work aids the development of cost-effective and environmentally-friendly hydraulic fracturing products and the formulation of new chemical designs. Finally, we submitted data confirming his influential citation, peer review, and publication record.

Our client’s Ph.D. in Civil (Geotechnical) Engineering served as additional proof of his capabilities as a researcher and major contributor to his field of materials engineering. Several recommendation letters by experts in our client’s field supported his I-140. As one of his recommenders put it, “The crucial outcome of [Client’s] study was a method to convert industrial wastes, particularly red mud, to high value added products. Red mud is a major byproduct of alumina refineries. […]. In the past, it was disposed of in two main ways, with refineries either dumping it offshore or transporting it to impoundments without processing it. Since stricter environmental regulations took effect, these options became unavailable. Yet the prevailing disposal techniques are still unsustainable. Therefore, new technologies are urgently needed for the disposal or recycling of this waste material. Notably, [Client’s] work has addressed this need.”

The approval of our client’s EB-1A petition is another favorable outcome for North America Immigration Law Group and our clients.
