On February 23rd, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Fellow in the Field of Molecular Biology (Approval Notice).

General Field: Molecular Biology

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Maryland

Approval Notice Date: February 23rd, 2016

Processing Time: 29 days (Premium Processing requested)

Case Summary:

With a 95.27% overall approval rate for EB-1A (Alien of Extraordinary Ability) cases, North America Immigration Law Group is one of the best in the business. This particular story of success is yet another example of our determination to help every client accomplish their goal of getting a green card.

The case: In this case, our client was a gifted postdoctoral fellow from India. His work in the field of molecular biology is both outstanding and compelling, and his research on the application of genetics and genomics in the study of human diseases in a zebrafish model is groundbreaking. Our legal team carefully understood and detailed our client’s work and demonstrated to the USCIS that his findings contribute to the field of molecular biology, genetics and genomics, and that he will continue to progress these fields, and others, in the United States.

The strategy: As part of our strategy, our EB-1A petition packet included recommendation letters volunteered by several expert molecular biologists. One of these letters firmly stated that “[Client’s] advanced research is invaluable precisely because it is pertinent to many aspects of human health. Because we as a country are dogged by diseases and conditions ranging from deafness to cancer, we need [Client] to continue his painstaking and effective research. It would behoove the United States to continue benefitting from the extension of [Client’s] efforts by enabling him to continue working within its borders.” These letters further fortified our case, and lent a hand in persuading the USCIS that halting our client’s work in the United States would be disadvantageous to the nation.

The conclusion: With a Ph.D. in Molecular Biology, 26 publications that have gathered 360 citations, and over 30 instances of peer review service, our client clearly had the credentials to file his case under EB-1A. He chose to upgrade his case to Premium Processing over two weeks after we filed the case on his behalf. NSC issued an approval notice 12 days later. We congratulate our client and wish him well as he continues to progress his field of molecular biology.
