Case Summary: 

A postdoctoral fellow immersed in the field of systems biology sought our legal expertise to help her get a green card. As expected, our legal team worked efficiently and effectively, which resulted in two approval notices: one for our client’s EB-2 NIW petition, and the other for her EB-1A (Alien of Extraordinary Ability) petition. It is not uncommon for clients to file two petitions under different visa categories as it gives them twice the chance of getting an approval notice from the USCIS. In this case, both our client’s petitions were approved. All she has to do now is file her I-485 application (final step in the green card process). Once that is approved, she will become an American permanent resident.

Case Details:

Part of our services entailed helping our client select several potential recommenders who were willing to lend their support for her EB-1A case. We narrowed down the list to six recommenders, and to our delight, all of them agreed to help our client. Their detailed testimonials were included in our comprehensive petition packet, and they furnished the USCIS with evidence that our client is an asset to the United States. Challenges Faced:

The biggest challenge that we faced was the wait time we were subjected to. The USCIS spent over 13 months adjudicating this EB-1A case (average processing time is between 4-9 months) and overall, we raised one service request on our client’s behalf. A little over a week after we received a reply from the USCIS informing us that our client’s case was undergoing additional review, we received the long-awaited approval notice.
