Case Summary:

A prominent senior biostatistician from China working in the field of cancer epidemiology hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions on her behalf: EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability). It is not unusual for clients to file two petitions simultaneously as it increases their chances of getting an approval. Say if one petition is denied, there is still a chance that the other may be approved. In this particular case, both of our client’s petitions were approved.

How We Approached the Case:

Our legal team is skilled at filing both EB-2 NIW and EB-1A cases and had no problems preparing two petition packets. Here are where the similarities lay:

  • Citation and Publication Record

When we filed the petitions, our client’s 17 published scientific papers had collected nearly 100 citations.

  • Recommendation Letters

In preparing the petitions, we prompted our client to contact other expert cancer epidemiologists to lend their support. She managed to convince six experts to furnish us with recommendation letters, one of whom wrote, “[Client’s] studies provide the cornerstone for current and ongoing scientific inquiry. Based on [Client’s] demonstrated value to American medicine, halting her work would be detrimental to medical research throughout the country.” Another expert stated, “In conclusion, [Client’s] ongoing research in the United States will not only continue to strengthen scientific study, but will continue to progress medical care and the health care industry for the betterment of our country.”

  • Research Efforts

Part of our legal services involved carefully reviewing and detailing our client’s various research exploits on cancer biology and genetic epidemiology. We established that her findings directly impact the United States medical research community and healthcare system.

Our EB1A and NIW petitions also detailed out client’s peer review experience and chronicled her two master’s degrees and her Ph.D. in Biostatistics. Overall, both petitions proved that our client’s work is of extreme importance to the United States and that only a scant handful of researchers with similar qualifications can attain the same level of success.

We would like to congratulate our client for obtaining two approval notices, and we wish her well as she attempts the final leg of the green card journey: the I-485 application.
