Case Summary:

An assistant member/assistant attending biostatistician approached North America Immigration Law Group (WeGreened.com) to file an EB-1 A (Alien of Extraordinary Ability) petition on his behalf. Thanks to Premium Processing (PP), our client received an approval notice from Nebraska Service Center a mere seven days after we filed the case on his behalf. PP allows for rapid adjudication—15 days as opposed to 4-9 months. The only catch is that this service is only available to EB-1 applicants and approximately $1000 more must be paid to the USCIS. However if time is of the essence, then PP is certainly a good option.

Legal Strategy:

Our goal was to present an airtight EB-1A case to the USCIS. We started off by urging our client to obtain recommendation letters from other biomedical researchers. Five experts obliged, and their letters were incorporated into our petition packet. We also excerpted relevant information from these letters to properly explain the crux of our client’s research on biostatistics and high-dimensional data analysis. Moreover, we used these letters to support our claim that our client’s work is of great value to the United States. For instance, this statement helped us make our point: “[Client’s] research is in a field that is essential to the public health of any nation, but particularly the United States, which has a large population and highly computerized medical records […] [Client’s] research in this field has addressed such disparate health concerns as cancer, the effects of steroids on children with rheumatic conditions, pulmonary fibrosis, and aortic stenosis. These health concerns represent some of the most pressing issues in the United States today, especially as our population ages.”

Besides strong recommendation letters, we also highlighted our client’s productive publication and citation record: 27 peer-reviewed scientific articles and one book chapter that had gathered an impressive 652 citations. We also listed the 15 times our client had performed peer reviews for high impact scientific journals.
