Service Center: Nebraska Service Center

State of Residence at the Time of Filing: California

Approval Notice Date: March 2nd, 2016

Processing Time: 35 days (Premium Processing Requested)

Case Summary:

Approximately three weeks after we filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a postdoctoral scholar from China, he opted to upgrade his case to be adjudicated under Premium Processing. From start to end, our client only waited 35 days for an approval from Nebraska Service Center.

With a Ph.D. in in Geological Sciences and extensive experience in the field of atmospheric sciences, our client had suitable credentials to file his case under EB-1A. His research efforts focus on the transport patterns and behavior of pollutants and aerosols in the atmosphere, rainfall and drought change in Amazonia, as well as the function and properties of clouds. We demonstrated that his findings help other researchers understand how pollutants behave and affect the quality of the atmosphere, as well as droughts related to climate change, which have important environmental applications in the United States and around the world.

Besides carefully detailing our client’s research ventures, we also incorporated his citation and peer review record into our EB-1A petition. At the time of filing, our client’s work had amassed 82 citations and he had conducted 29 peer reviews for more than half a dozen scientific journals. Our legal team also highlighted his 6 peer-reviewed scientific articles and 19 conference presentations.

To further strengthen our EB-1A case, we included testimonials contributed by expert atmospheric scientists. Here are several statements extracted from their recommendation letters:

  • “Without a doubt, [Client’s] most recent research has been majorly influential on meteorology as a field, and on global climate change altogether […] In fact, this project is just one example of [Client’s] sustained track record of substantial contributions to the field, which has extended throughout his career. I consider [Client] to be among the top experts in our global field of endeavor, a position which he has attained due to his novel and superior contributions.”
  • “The United States has long been a leader in the atmospheric sciences, and to continue to uphold this status, we need access to [Client’s] specialized expertise within our research community. Surely, a researcher with [Client’s] skillset and experience in the field of atmospheric science is irreplaceable in the United States’ scientific community. The future is looking very bright for [Client], who has already done so much for climate change research and air pollution fields.”
  • “[Client] has made unrivaled contributions to the field of atmospheric sciences, and in order for advances in our field to continue at the same pace, [Client] must continue in his important work without interruption.”

We would like to congratulate our client on overcoming this significant hurdle in the green card process, and we wish him all the best as he partakes in the final step of the green card journey: the I-485 application.
