Case Summary:

A postdoctoral fellow from China hired North America Immigration Law Group to help him achieve his dream of becoming an American permanent resident. With a doctorate in chemistry, years of experience working in his field of study, and various professional accomplishments under his belt, our client’s credentials were suitable to file his I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category.

Scholarly and Research Achievements:

Considering EB-1A is held to a very high standard of law, petitioners filing under this category must possess specific qualifications if they want their petition to be approved. In this case, we thoroughly demonstrated to the USCIS that our client met three out of the 10 requirements that they had set in place. The three requirements were:

  1. Judge the work of others: When we filed the case, our client had already conducted 19 peer reviews for various high impact scientific periodicals. Last year, he was even recognized by one of these scientific journals as one of the top 10 peer reviewers of the year.
  2. Authored scholarly articles in professional journals: Over the course of his career up to the date that we submitted his EB-1A petition to the USCIS, our client had published 8 scientific articles, 1 book chapter, 1 published U.S. patent, and 1 licensed U.S. patent application.
  3. Made original scientific contributions of major significance: Our client’s work has significantly contributed to the progress of other chemists’ research. This is illustrated by the 254 citations gathered from his work.

Evidence of Accomplishments:

We submitted evidence of our client’s various accolades by incorporating thank you letters, Google Scholar references, highlights of his publications, and other relevant pieces of information that would lend a hand in getting our petition approved. The most important part of our collection of evidence were the six recommendation letters that our client had obtained from other experts in his field of chemistry. They served as proof that our client’s work is of great value to the United States. For instance, one of these letters stated that “[Client’s] findings are directly relevant to the U.S. pharmaceutical industry, which depends on the cheap, ready availability of many fine chemicals of this nature to act as pharmaceutical building blocks […] [Client’s] advances in chemistry help to lay the foundation for this continued domination by the U.S. pharmaceutical industry in the global market.” Another recommender wrote, “… It is also clearly in the interest of the United States to allow [Client] to continue his work unimpeded.”

Petition Approval:

Our diligent efforts and our client’s strong credentials encouraged the USCIS to approve this EB-1A petition. As the cherry on top of the cake, the USCIS did so in merely 10 days (thanks to Premium Processing). Our client recently retained our services to help him file an I-485 application. This is the last step in the green card process and once approved, our client will become an official American permanent resident.
