Case Summary:

A well-known research associate from China hired North America Immigration Law Group (WeGreened.com) to help him with the first step of the green card process: the I-140 petition. After conducting an initial evaluation, we confirmed that our client should proceed with EB-1A (Alien of Extraordinary Ability). The USCIS has a strict set of requirements in place for this visa category. Petitioners must meet at least three out of the 10 requirements or risk getting their petition denied.

The Three Requirements:

Our job was to assemble a strong EB-1A petition on our client’s behalf. We needed to demonstrate to the USCIS that he met the following three requirements:

  1. Judge the work of others: The many years that our client spent in the field of chemistry has led him to become one of the field’s leaders. We established that his opinions are highly valued by other researchers, and this is clearly exemplified through the number of times he has conducted peer reviews: 10 times.
  2. Original contributions: At the time of filing, our client’s work had gathered an impressive 637 citations, proving that other chemists are using his findings to progress their research.
  3. Authorship of published scholarly articles: Our client has published two dozen papers, all of which appeared in prominent scientific journals.

Once we had gathered enough evidence to prove to the USCIS that our client fulfilled three requirements, we made it clear that he is an asset to the United States. For instance, we reviewed his research projects on rhodium-catalyzed asymmetric hydrogenation, which progresses not just the field of chemistry, but the United States pharmaceutical and medical industries. Furthermore, we incorporated recommendation letters that our client obtained from other influential chemists in his field. These letters supported our client’s EB-1A petition and played an important role in our case. One of our client’s recommenders wrote, “[Client] is conducting research in an area of global medical importance …[and if he] is granted the opportunity to continue his research in the United States, there is no doubt that he will continue to produce research of major significance to both myself and my colleagues.”

Successful Efforts:

We are glad that our client’s solid credentials and our diligent efforts paved the way for case approval. As a result of Premium Processing, Texas Service Center sent us an approval notice merely 8 days after we filed the EB-1A petition on his behalf. We congratulate our client on this big win, and wish him well as he continues to advance the field of chemistry.
