On March 10th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Senior Engineer in the Field of Biomedical Engineering (Approval Notice).

General Field: Biomedical Engineering

Position at the Time of Case Filing: Senior Engineer

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: New Jersey

Approval Notice Date: March 10th, 2016

Processing Time: 4 Days (Premium Processing Requested)

Case Summary:

Merely four days after we filed an EB-1A (Alien of Extraordinary Ability) petition on our client’s behalf, we received an approval notice from Nebraska Service Center. Although the accelerated timeline was largely due to Premium Processing, we have no doubt that the combination of our client’s strong credentials and our well-prepared presentation lent a hand in rapid case approval.

Our EB-1A petition dossier was comprised of a wealth of information on our client’s copious scholarly and professional feats. His Ph.D. and M.Sc. degrees are a testament to his talents for conducting original research in his field of biomedical engineering. Furthermore, the nearly 500 citations to his work, the 13 times he conducted peer reviews, and his 32 publications (16 articles and 16 conference abstracts) highlight the importance of our client’s work to other researchers who, like him, are steadily advancing the field.

We urged our client to ask other experts in his field for recommendation letters. As these letters attested to the value of our client’s development of new animal models, medical devices, and novel therapeutic solutions to improve the success of arteriovenous (AV) fistula operations, they ensured that our case was airtight. For instance, one of these letters stated that our client’s work has “… led to much advancement in using this technique and allowed for great progress in the field of biomedical engineering. With that in mind, it would be beneficial to the biomedical engineering community, both in the US and worldwide, if [Client] is able to continue his research.”

We are pleased that the USCIS agreed with our EB-1A presentation and ultimately granted their approval. Our client is now significantly closer to green card success: North America Immigration Law Group (WeGreened.com) recently filed I-485 applications (final procedure in the green card process) for our client and his wife, and we join them as they await optimistic results from the USCIS.

Premium Processing: Is It Right for You?

Premium Processing (PP) is an option available only to specific visa categories, EB-1 being one of them. All you have to do is pay the USCIS an additional $1,225 and the immigration officers will adjudicate your case within 15 days. The timeline difference is huge when compared to the 4-9 months that they usually spend reviewing regularly filed petitions. PP is a good option for petitioners who are unwilling or unable to wait several months for the USCIS to take action on their petition.
