Case Summary:

This EB-1A (Alien of Extraordinary Ability) case involved a postdoctoral research associate from India. He hired North America Immigration Law Group (WeGreened.com) to help him with the first step in the green card process: the I-140 petition. After carefully evaluating his credentials, we confirmed that EB-1A would be the best category to file his I-140 petition under, and we worked meticulously to prepare a strong petition on his behalf.

EB-1A Petition Contents:

EB-1A has a very high standard of law and if petitioners want a shot at obtaining case approval, they have to prove that they meet at least three out of the 10 requirements set by the USCIS. Our mission was to prove that our client met three requirements and back up these claims with solid proof. Here are the requirements that we focused on

1. Judge the work of others: Using thank you notes from journal editors that were provided by our client, we proved to the USCIS that our client had already completed 26 peer reviews at the time of filing. We established that only leaders in the field are invited to judge the work of others and that our client’s impressive peer review record serves as evidence that his insights are highly valued by other pharmaceutical scientists.
2. Significant contributions: We used Google Scholar and other similar references to determine that our client’s work had collected 205 citations at the time of filing. We used this number to demonstrate to the USCIS that our client’s findings progress the research of other scientists.
3. Authorship of scholarly articles: The 30 articles that our client published appeared in some of the most well-known scientific journals. These publications served as additional evidence that our client’s work is of great value to other researchers in the field.

Once we had determined the three requirements, we worked on obtaining additional proof to bolster our client’s EB-1A petition. For instance, we used his doctoral degree to verify that he is armed with the skillsets to continue conducting impactful research in the United States. We also reviewed his research on pharmaceutical analysis, bioanalytical chemistry, natural products and dietary supplements, and ascertained that his investigations benefit the American pharmaceutical industry. Furthermore, we included recommendation letters provided by other experts in the field to support our client’s bid for permanent residency. One of these letters stated that “[Client’s] consistent record of excellence, as demonstrated by his groundbreaking research on the safety of dietary supplements as well as his overall record of citations and publications, attests to [Client’s] place as one of the most important researchers in the field of botanicals. All of these repeated successes indicate that [Client] will continue to advance the field as a whole, and as such his current and future research presents an invaluable opportunity for the scientific community of the United States.”

Petition Approval:

We are pleased that the combination of our client’s strong credentials and our diligent work resulted in an EB-1A petition approval.
