On March 29th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for an Associate Chief Resident in the Field of Immunology (Approval Notice).

General Field: Immunology

Position at the Time of Case Filing: Associate Chief Resident

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Ohio

Approval Notice Date: March 29th, 2016

Processing Time: 28 Days (Premium Processing Requested)

Case Summary:

A respected associate chief resident from India hired North America Immigration Law Group (WeGreened.com) to help him obtain a green card. Our client, who is researching the mechanisms of immune system activation in response to pathogen infection, had the educational and professional background necessary to file his I-140 petition under EB-1A (Alien of Extraordinary Ability).

Our Law Firm’s Role:

We were tasked with compiling as much relevant information as we could on our client’s copious achievements. Among other things, we needed to build a strong EB-1A case on his behalf and prove to the USCIS that he had significantly contributed to the field, had published papers, and had judged the work of others. We turned to our client’s portfolio to obtain the information that we needed: we summarized his 7 published papers and one book chapter that had gathered 159 citations, and the 20 peer reviews he had conducted for scientific journals.

Additional Proof:

Although we had a strong case, we needed to make it airtight. We addressed this concern by padding the EB-1A petition with recommendation letters signed by other medical experts. The six letters that our client sent to us supported not just our claim that our client’s research is important to the field of immunology, but to the United States as a whole. Here are several excerpts:

“With an established record of success behind him, [Client] has become a driving force within the medical research community, whose work will no doubt continue to open up new possibilities and lead the direction of future research through the coming years.”

“[Client’s] investigations have already placed him at the forefront of immunology and cell biology research and will continue to bring new insights about the inner workings of the human immune system.”

“Taking into consideration the influential role [Client] has come to occupy and the many achievements he has made with his research, which have greatly improved our understanding of the immune system, there can be no doubt that [Client] has become an irreplaceable member within the scientific community. Without his efforts, there would be prolonged delays to the development of treatments for many diseases related to the immune system like AIDS, malignancies, and a host of autoimmune disorders like type‐1 diabetes and rheumatoid arthritis.”

We are pleased that our presentation of our client’s strong credentials led to an EB-1A petition approval. From the date we filed it to the date it was approved, our client only waited 28 days (the rapid adjudication that our client enjoyed was thanks to Premium Processing). We are currently helping our client prepare his I-485 application. This is the final step that our client needs to take in order to receive his green card, and we guarantee that we will do our best to help him get it.
