Approval Notice Date: April 1st, 2016

Case Summary:

Just four days after we filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a talented senior engineer from China, the USCIS sent us an approval notice. Although we have Premium Processing to thank for the rapid adjudication, we have no doubt that our careful presentation of our client’s strong credentials lent a hand in case approval.

What makes a strong EB-1A petition?

North America Immigration Law Group’s experience putting together strong EB-1A petitions has taught us a thing or two about what makes a strong case. Although case approval heavily depends on the petitioner’s qualifications and the immigration officer in charge of the case, here are some of the main things that come into play:

  1. Publication and citation count: One way that the USCIS determines if a petitioner’s work is of value to the United States is by reviewing his/her citation and publication record. In this case, our client’s research had led to the publication of one book chapter and 14 scientific articles that had amassed 974 citations—an impressive feat.
  2. Review experience: Listing our client’s review experience played a role in convincing the USCIS that his opinions are highly respected by other researchers in the field of electrical engineering. When we filed the case, our client had conducted 25 peer reviews for various high impact scientific journals.
  3. Research results: In order to persuade the USCIS to approve our client’s EB1A petition, we had to be able to inform them of the many benefits that his work has to the nation. After carefully reviewing our client’s various research projects on the electrical and thermal properties of newly developed nanomaterials, we established that his research progresses technological development as a whole.
  4. Recommendations: Finally, we needed the support of other expert electrical engineers to strengthen our EB-1A petition. We helped our client shortlist potential recommenders and urged him to reach out to them for testimonials. Our client convinced five experts to furnish us with recommendation letters, one of whom described our client as “… a researcher of unparalleled skill and vision…” Another expert stated that “Without a doubt, [Client] is one of the foremost influencers in his area of specialty. His opinions and findings have repeatedly shaped the landscape of electrical engineering and nanotechnology, advancing related disciplines such as materials science and applied physics.”

Case Approval:

We are pleased that Nebraska Service Center agreed with our presentation of our client’s EB-1A petition and ultimately granted their approval. He is now one step closer to his green card, and we wish him well as he continues to advance the field of electrical engineering.
