Success Stories: Nebraska Service Center Only Spent 6 Days Adjudicating an EB-1A Petition for Principal Firmware Engineer in the Field of Mechanical Engineering

Client’s Testimonial:

“Really appreciate all your help! You are real professionals […] Thanks!”

On April 6th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Principal Firmware Engineer in the Field of Mechanical Engineering (Approval Notice).

General Field: Mechanical Engineering

Position at the Time of Case Filing: Principal Firmware Engineer

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: California

Approval Notice Date: April 6th, 2016

Processing Time: 6 Days (Premium Processing Requested)

Case Summary:

A California-based engineer hired North America Immigration Law Group (WeGreened.com) to help him get one step closer to permanent residency. We determined that the best way to make this happen would be to file an I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category. To increase his chances of attaining petition approval, our client elected to file an I-140 petition under EB-2 NIW (National Interest Waiver) as well. Because the USCIS approved his EB-1A petition in just 6 days (the rapid adjudication is largely due to Premium Processing), our client decided that there was no need for NIW. Since his EB-1 priority date is current, he is eligible to immediately file an I-485 application based on his approved EB-1A petition.

Thorough Petition Packet:

We pride ourselves on paying very close attention to detail, and every petition packet that we have put together for our clients showcased our diligence and meticulousness. This EB-1A petition packet is no different; we did everything we could to shed light on our client’s various professional and scholarly achievements, which was partly composed of his 10 published papers, the 40 times he assessed the work of his peers for well-known journals, and the 211 citations collected from his work. We also carefully reviewed our client’s work on teleoperation and haptic systems, as well as hard disk drive system storage. In reference to the aforesaid details, we concluded that his research advances the American technological sector.

To make our client’s EB-1A case even stronger, we included recommendation letters that he had collected from other influential mechanical engineers based all around the world. Our goal was to inform the USCIS that our client’s work transcends borders and that it pushes the entire field forward. The five signed letters that were included in the petition packet contained statements such as this: “As scientists and industrial leaders attempt to make further advancements in teleoperation systems and other areas of robotics pertinent to [Client’s] area of study, foundationally applicable research is required for any sort of innovation. It is clear that [Client] is a pioneering leader in this area; without his continued efforts, research and development related to teleoperation systems and the general field of robotics will inevitably stagnate. [Client’s] past record of success in his research is a veritable guarantee of more successes in the future.”

One More Step to a Green Card:

Our client has one final hurdle to overcome before he can attain a green card. He has to file I-485 applications for himself and his dependent(s). Once the USCIS approves their applications, they will become permanent residents. Our client recently informed us that he will be taking this step with the help of our comprehensive D.I.Y. Packet. We wish him well with this and look forward to updates.
