On April 7th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Fellow in the Field of Molecular Biology (Approval Notice).

Case Summary:

At the start of the year, a talented postdoctoral fellow from India hired North America Immigration Law Group to file an EB-1A (Alien of Extraordinary Ability) petition on his behalf. Preparation Period:

We were tasked with putting together a strong EB-1A petition packet to convince the USCIS that our client should continue his research unhindered in the United States. We had to demonstrate his position of leadership in the field of molecular biology and highlight his various professional accomplishments. It took us exactly 3 months to prepare our client’s petition packet before we submitted it to the USCIS. Here are some of the things it contained:

  1. Record of achievement: We noted everything from the number of times our client conducted peer reviews to the amount of citations his work had amassed. At the time of filing, our client had already reviewed 18 journal articles and 52 abstracts, and his 8 publications had collected over 600 citations.
  2. Recommendation letters: We needed the support of our client’s peers to increase our chances of obtaining petition approval. As with all our clients, we carefully reviewed a list of professionals working in the field and helped our client select a handful who could serve as strong recommenders. The four experts we selected were composed of independent and dependent recommenders, and when approached by our client, they gladly agreed to lend their support. We also accounted for his work on the design and development of therapeutics for the treatment of cancer and Alzheimer’s disease, and concluded that the U.S. medical sector gains aplenty from his findings.
