Case Summary:

A well-known research scientist from India hired North America Immigration Law Group (WeGreened.com) to help him obtain green cards for himself and his spouse. There are two steps in the green card process: the I-140 petition and the I-485 application. We started off by evaluating our client’s credentials and concluded that EB-1A (Alien of Extraordinary Ability) was the best way forward.

In preparing our client’s EB-1A petition dossier, we pinpointed several main points to focus on. These points included his citation count, peer review experience, and publication record. At the time of filing, our client’s work had gathered 151 citations and he had conducted 55 peer reviews for scientific journals. Furthermore, his research had led to the publication of 15 scientific articles, 1 book chapter, and 24 abstracts.

Although our client had strong credentials, presenting his achievements was not enough to secure a petition approval. We needed to demonstrate to the USCIS exactly how useful our client’s work is to the field of neuropharmacology. Using what we learned, we concluded that our client’s findings have various applications, one of which is therapy development for alcohol addiction, an unmet public health problem in the United States.

To support our client’s EB-1A petition, we encouraged him to mobilize a handful of other experts in his field, all of whom we helped select. We needed these experts to sign testimonials stating that our client is a leader in the field and that interrupting his work in the U.S. would bring about unnecessary consequences. Here are several extracts from these recommendation letters:

“In summary, [Client] is a talented researcher in the neuropharmacology field. His work has already provided distinct advantages to the United States in regards to alcohol addiction. I firmly believe his continued presence be beneficial to the United States, and I strongly endorse his U.S. residency petition.”

We congratulate our client for obtaining an EB-1A petition approval. We recently helped him and his wife file their I-485 applications, and we join them as they await a favorable decision from the USCIS. In the meantime, we wish our client the best with his continued research.
