Success Stories: Egyptian Surgeon Who Received an RFE and Ultimately an NIW Petition Approval Is Now Eligible for Immigrant Visa Processing

Client’s Testimonial:

“I contacted this professional group on the day that I received the denial note for my EB1A I was cracked and desperate at this time, although I have good credential and I applied on my own believing the attorney will not make any difference especially if you have good credentials but when I contact Chen I discover this is wrong and the way and style to express your credential fact into a legal argument is the mainstay for approval of any petition. First day I contacted her I was very optimistic that she will get my petition approve, she is very knowledgeable about each immigration petition and advise me to file NIW instead of second EB1A. I hired her for filing NIW and I immediately notice the difference between my previous filing and her new filing especially in LORs & petition letter. She was supportive and confident that we will get this petition approved. Once we finished the filing I become confident too that I will get it this time. Everything was organizing and sufficient to prove the face in legal argument. At the end the case approved as she promised and I am so happy for this and highly recommend her group for all applicants. Please note hiring good experienced attorney will save time, money and avoidable denial of your case.”

Case Summary:

A gifted surgeon hired North America Immigration Law Group (WeGreened.com) to file an EB-2 NIW (National Interest Waiver) petition on his behalf. He had initially filed an EB-1A (Alien of Extraordinary Ability) petition on his own but received a denial. With our help, he is now one step closer to a green card (which can be obtained via immigrant visa processing).

Immigrant Visa Processing (IVP):

Green card applicants have two means to obtain a green card: filing an I-485 application if they are residing in the U.S. or undergoing IVP if they are living abroad. As our client is residing in his birth country of Egypt, he has to undergo IVP. Amongst other things, he must pay the fees, submit the relevant forms, and attend an interview at the right American consulate or embassy. Assuming everything goes according to plan, our client and his dependents will receive an immigrant visa, which they can then use to enter the U.S. as permanent residents. Following their entry into the country, their green cards will be mailed to their American address.

Qualifying for the national interest waiver:

When we evaluated our client’s credentials, we determined that the best way for him to get an I-140 petition approval would be via EB-2 NIW. Once an attorney-client relationship was established, we immediately started compiling evidence that proved he qualified for the national interest waiver. We detailed his M.B.B.Ch., the 70 citations to his work, and his 10 publications. We also touched on his peer review experience, and noted his research efforts on enhancing medical practices and reducing complications following surgical operations. Based on all the information we had gathered, we were able to conclude that our client directly contributes to the American biomedical equipment industry as well as the medical and healthcare industries. Additionally, his robotic radical prostatectomy research efforts are contributing to the United States’ efforts to improve surgical practices and medical treatments.

To further strengthen our client’s EB-2 NIW petition, we incorporated recommendation letters contributed by his peers. One of them had this to say about our client’s research efforts: “His [Client’s] advanced reports and techniques have not just increased our general understanding of complications and issues (medical and surgical) related to urology, they have given us the ability to apply that understanding in ways that improve our current practice and treatment of patients.”

Attaining petition approval:

The USCIS spent 9 months and 10 days adjudicating our client’s petition before deciding to grant their approval. It was a bumpy road to the finish line: we raised a service request on our client’s behalf when his case was considered outside the average processing time, and responded to a Request for Evidence (RFE) issued by the USCIS. Our prompt and efficient response to the RFE paved the way for case approval, and we congratulate our client on this joyous occasion.
