Case Summary:

An accomplished postdoctoral researcher from Nepal contracted North America Immigration Law Group (WeGreened.com) to help him conquer the first portion of the green card process: attaining an I-140 petition approval. As we filed our client’s I-140 petition under the EB-2 NIW (National Interest Waiver) visa category, we had to prove to the USCIS that his work is important to the United States.

Our client obtained his B.Sc. and M.Sc. from a top university in his birth country of Nepal whereas his Ph.D. was obtained from an American university. We demonstrated that his advanced degrees have readied him for a research-driven career in the field of physics. His findings have significantly impacted the United States thus far—most notably the country’s healthcare and pharmaceutical industries—and we proved that not many other similarly qualified researchers can carry out such comprehensive investigations.

Our client’s EB-2 NIW petition packet was partly comprised of his professional accomplishments such as his citation count and publication record. At the time of filing, these figures stood at 34 citations and 5 journal articles. Our client also had 10 conference abstract publications, 5 workshop participations, 13 oral/poster presentations, and an invited talk to his name. To bolster our client’s case, we asked him to gather the support of his peers. The six physicists whom he approached all agreed to advocate for the approval of his EB-2 NIW petition by signing recommendation letters. These letters contained statements such as these:

• “Researchers worldwide are addressing debilitating diseases from a variety of perspectives, and [Client’s] is an extremely significant contributor to these objectives. [. . .] I therefore recommend without question that he be offered the chance to proceed in his noble endeavors, for the betterment of the research community and the United States.”

• “If he were disallowed from continuing his present ventures, his employer, the nation, and research in the domain of molecular dynamics worldwide would be deprived of an undeniable asset.”

Overall, the USICS spent 8 months and 15 days reviewing our client’s EB-2 NIW petition before granting their approval. We raised a service request on our client’s behalf when his case was considered outside normal processing times but aside from that, everything moved along smoothly. We congratulate our client for obtaining an I-140 petition approval and we wish him well as he continues to innovate computational Molecular Dynamics (MD) simulation techniques and numerical calculations of target molecular systems and molecules of biomedical significance.
