Success Stories: One Week after Filing, California-based Postdoctoral Scholar in the Field of Pharmaceutical Sciences Receives EB-1A Petition Approval

Client’s Testimonial:

“It was a long and tough journey to prepare the EB-1A I-140. However, with the professional assistance and prompt feedback from the NAIL firm, this process has become much easier. They always stick to the deadlines that have been promised (preparing reference letter in 10 days, petition letter in 10 days). Thank you Chen associates for your enormous help, which helped me get my case approved one week after USCIS received my Form I-140. I will absolutely recommend you to every of my friends who will be applying for the green card in the future.”

Case Summary:

A gifted postdoctoral scholar from China hired North America Immigration Law Group (WeGreened.com) to help him get one step closer to a green card. Our client, a pharmaceutical sciences expert, is developing effective targeted anticancer drug delivery nanocarriers and investigating genetic targets for treating liver fibrosis. To date, his work has led to various applications and accolades, and we proved it to the USCIS by documenting the following in his EB-1A (Alien of Extraordinary Ability) petition packet:

  1. To demonstrate that our client’s findings are of great value to the U.S., we noted their various applications, particularly in combating the toxicity and insufficient efficacy of currently used chemotherapy drugs. We established that our client’s work progresses the country’s medical and pharmaceutical sectors, and by extension, the economy as a whole.
  2. Our client’s work is also being used by other researchers in the field to advance their work. This is exemplified through the 236 citations amassed from his work, particularly his 15 journal articles and book chapter. His opinions are also held to high regard—as exemplified through his peer review record (40 reviews for 15 journals).
  3. Like all our other cases, we had to be sure that we had sufficient evidence to prove to the USCIS that we had a solid argument. We prompted our client to reach out to a handful of his peers for recommendation letters. These experts needed to advocate for the approval of our client’s EB-1A petition and acknowledge the fact that our client is an asset to the nation. According to one of these experts, our client’s work has quite an impact on researchers at home and abroad. He also stated that “[Client] approaches his research with inventive methodologies, and his aptitude for analysis is unequaled in the field. His work has already proved to be instrumental in shaping research tendencies in the field of pharmaceutical sciences, and his continued and active involvement in scientific investigation is critical to the sustained progression of our understanding of drug delivery for the treatment of cancer…maintaining [Client’s] research efforts is absolutely necessary for the health of the field, as well as the public.”

Merely one week after we filed the comprehensive petition on our client’s behalf, the USCIS responded with an approval notice. This EB-1A approval meant that our client could adjust his status for permanent residence soon (and not wait several years for his priority date to become current). With our help, he chose to do so a little over a week after his petition was approved. We join him and his wife as they await favorable news from the USCIS.
