Case Summary:
This EB-1A (Alien of Extraordinary Ability) case involved a postdoctoral associate from India. He approached North America Immigration Law Group (WeGreened.com) when he decided that he wanted to attain green cards for himself and his wife. Our client, who has an M.Sc. and a Ph.D. in High Energy Physics, has extensive experience developing the software framework for the acquisition of physical data in particle detectors that led to the discovery of the Higgs boson, the search for particle resonances that decay to two Higgs bosons, and the prediction and observation of the first Dalitz decay in the charm quark sector.
Building a convincing argument:
As the attorney-on-record, we were tasked with putting together a convincing EB-1A petition dossier for our client. We started off by asking him to reach out to other experts in the field of particle physics for recommendation letters. To simplify our client’s work, we helped him select whom to contact—we made sure that his recommenders were experts at what they did and that they were familiar with our client’s work through his publications, which at the time of filing was in the hundreds range. Our client returned with four signed recommendation letters, all of which confirmed the value of his work to the United States. This is what one of them said: “[Client] possesses a clear and sustained record of success and originality in the field, and his research efforts are precious to the United States in regards to public health and safety as well as national security.” We also noted the staggering 45,476 citations to his work and demonstrated to the USCIS that our client’s findings are changing the way researchers around the world are tackling particle physics research. Additionally, we noted the 11 times he assessed the work of his peers, which denoted the high value the scientific community places on his insights.
Moving on to the final step:
There are two steps in the green card process: the I-140 petition and the I-485 application. As our client’s I-140 petition was approved under the EB-1A visa category, he is now left with the final step of green card proceedings: the I-485 application. We are currently helping him and his wife put together their applications and we look forward to a positive outcome from the USCIS.
