Case Summary:

A prominent physician/academic hospitalist from Nepal hired North America Immigration Law Group (NAILG) to file an EB-2 NIW (National Interest Waiver) and an EB-1A (Alien of Extraordinary Ability) petition on his behalf. However, after our client’s EB-1A petition was approved just 13 days after filing, he opted out of filing an EB-2 NIW. The reason why our client’s EB-1A was approved so quickly is because he elected to pay an extra $1,225 to the USCIS to have his case processed within 15 calendar days. This turned out to be a good move as he saved up to 9 months waiting for action to be taken on his case. He can now move on to the final step of the green card process: filing I-485 applications for himself and his spouse.

What did the EB-1A petition contain?

An important element of our client’s EB-1A petition was the inclusion of six recommendation letters contributed by other medical experts. From a well-known cardiologist to a prominent professor, our client’s recommenders are important internal medicine researchers whose support proved to the USCIS just how essential our client’s work is to the United States. According to one of these experts, our client is “… precisely the type of researcher that the United States’ healthcare industry needs to stay on a trajectory of uninterrupted growth in cost-efficiency, patient care quality, scientific discovery, and clinical efficacy.”

Alongside these letters of support were details on our client’s professional achievements. These included, but were not limited to: his publication record, peer review experience, and citation count. When we filed the case, these numbers were 58 publications, 13 peer reviews, and 111 citations. To boot, we also listed our client’s research on various newer oral anticoagulants, on large-scale healthcare trends and outcomes, and on a central drug used to treat immune disorders and some cancers. We determined that his findings advance health professionals’ understanding of health processes, clinical recommendations, and pharmaceutical applications.

What next?

Now that our client has overcome the first hurdle of the green card process, he only has one more to go before he can get his green card. All that is left is to file I-485 applications for himself and his wife to adjust their status for permanent residence. Once the USCIS approves their applications, they will receive their green cards. Our client is embarking on this journey with the help of our comprehensive D.I.Y.
