Case Summary:

An assistant professor from China hired North America Immigration Law Group (WeGreened.com) to help him overcome the first hurdle of the green card process (the I-140 petition). To increase his chances of getting a petition approval, he wanted us to file two I-140 petitions: one under EB-1A (Alien of Extraordinary Ability) and another under EB-2 NIW (National Interest Waiver). Although our client was fortunate enough to get both his petitions approved less than 2 weeks apart, we are particularly pleased about the approval of his EB-1A petition. This allows him to proceed with the next step of the green card process (filing an I-485 application) without needing to wait several years for his priority date to become current.

Putting together two I-140 petitions:

As EB1A and NIW are two different visa categories, we had to put together two different petition packets for our client. Even so, several details overlapped:

  1. Recommendation letters: We urged our client to contact other influential mechanical engineers for recommendation letters. As part of our comprehensive services, we helped him select these recommenders by making sure that they were familiar with his work and/or had worked with him. Our client obtained six letters, one of which stated that “…[Client’s] deep level of experience and high caliber technical skills combine to make him an especially valuable contributor, who has certainly earned a permanent place in the field’s developmental vanguard.”
  2. Presentation of our client’s credentials: When we filed our client’s petitions, he had published 13 scientific articles and conducted 30 peer reviews. We also noted the 239 citations gathered from his work in the field of mechanical engineering.
  3. Value of our client’s work to the U.S.: With a Ph.D. in Engineering Mechanics and Mechanical Engineering, we established that our client is equipped with the skills needed to carry out impactful research that benefits the United States. We also determined that his investigations on design and crashworthiness optimization methods for industrially-important structures and systems are contributing to the country’s automotive, aerospace, military, and industrial engineering efforts, transportation sector, and national economy.

We congratulate our client on his EB-1A and EB-2 NIW petition approvals, and we wish him well as he adjusts his status for permanent residence.
