General Field: Electrical Engineering

Position at the Time of Case Filing: Senior Research and Development Engineer

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Minnesota

Approval Notice Date: May 26th, 2016

Processing Time: 10 Days (Premium Processing Requested)

Case Summary:

The field of electrical engineering has seen much progress since our client dedicated himself to developing low-power, high-density, and cost-effective magnetic and spintronic devices for next-generation computing and storage systems. Being a senior research and development engineer, it comes as no surprise that he conducts research that yields impactful results for his company, the United States, and the field as a whole.

At the end of last year, our client engaged our services to help him obtain a green card. Five months into the contract, we filed an I-140 EB-1A (Alien of Extraordinary Ability) petition on his behalf. Thanks to Premium Processing (PP), our client only waited 10 days before he was notified that his petition had been approved. Obtaining an I-140 EB-1A petition approval meant that our client had overcome the first hurdle in the two-part green card process. Now all that is left is for him to file an I-485 application to adjust his status for permanent residence. Speaking of which, we are currently helping him put together his application and we look forward to helping him obtain his green card.

Building a strong EB-1A case:

There is no denying that EB-1A is a very difficult visa category to qualify for. Green card applicants with approved EB-1A petitions are usually the cream of the crop in their respective fields and our client is certainly one of them. The many years that he has spent conducting research had led to the publication of 21 scientific articles which had collected 140 citations when we filed the case. At that time, our client had also assessed the work of his peers 59 times for over a dozen scientific journals.

Part of our job was to prove that not many other electrical engineers can attain research results of the same caliber as our client and that he is an irreplaceable presence in the American scientific community. One way we did this was by encouraging our client to gather the support of his peers. He did this by asking them to sign recommendation letters that verified the value of his research. From a professor in Singapore to a scientist in Spain, six of our client’s peers agreed to contribute recommendation letters. This is what one of them said about our client: “In conclusion, [Client] is indeed an individual of extraordinary ability and has made revolutionary contributions to the field of magnetic materials and devices, which has been proven by his solid research work, publications, and professional experience. [Client’s] unprecedented achievements make him an unsurpassed scientist who is certain to continue producing valuable contributions that benefit academic researchers, industry, and the United States as a whole.”

We congratulate our client for obtaining an EB-1A petition approval and we thank him for choosing to embark on the final leg of the green card journey with us.
