Case Summary:

Not long ago, North America Immigration Law Group (NAILG) helped a gifted postdoctoral research scholar from India obtain an EB-1B (Outstanding Professors and Researchers) petition approval. As EB-1B is an employer-sponsored visa category, our client had to secure his employer’s full support before retaining our services. His employer—a top medical school in the US—agreed to lend their support. After we had obtained the relevant paperwork from them, we got to work building a strong EB-1B case for our client.

What did the petition contain?

We had to prove to the USCIS that our client not only has an offer of ongoing employment, but is also experienced and recognized internationally as outstanding in the field of biochemistry. Thanks to the comprehensive research summary that our client sent to us so that we could better understanding his research, we were able to pinpoint his research focus. We determined that our client’s investigations on TRIM72 (a protein required for lung cell repair), the molecular mechanism of fetal alcohol spectrum disorder, and lectins, address some of our nation’s most pressing issues in understanding how TRIM72 acts as a pulmonary protective or lung protective agent and how we may develop preventative strategies for alcohol-related birth defects.

Besides carefully accounting for our client’s work, we also documented his doctorate in biochemistry, the 9 times he assessed the work of his peers, the 17 publications to his name, and the 157 times other researchers had cited his findings. Taken together, these achievements undoubtedly established our client’s influence in the field of biochemistry. To further bolster our client’s EB-1B petition, we incorporated recommendation letters signed by six other influential members of the biochemistry research community. According to one of them: “This is the type of advancement that saves lives and contributes to the considerable renown that the United States has built within the international medical community. Since [Client’s] qualifications are such that these types of developments may be expected regularly, this is an opportunity for the United States to retain a truly trailblazing researcher.”

Getting one step closer to green card success:

Largely thanks to Premium Processing (PP), our client received notification of case approval just 11 days after it was filed. PP is an add-on service offered by the USCIS that allows petitioners to have action taken on their cases within 15 calendar days. All they have to do is pay the USCIS an additional $1,225 and submit an I-907 form. We congratulate our client for obtaining an EB-1B petition approval, and we thank him for choosing our law firm to represent his case. We wish him the best as he adjusts his status for permanent residence by filing an I-485 application.
