Case Summary:

Less than two weeks after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition for a senior research associate from China, the USCIS took action on his case. To our delight, they approved our client’s petition, propelling him one big step closer to the green card finish line.

“Since [Client] is one of the leading scientists in biochemical pharmacology research, it is crucial that his work continue. Without [Client’s] sustained research, advancements in cellular pharmacology and cancer biology in the United States will certainly suffer in his absence.”

This quote was taken from the recommendation letter provided by one of our client’s recommenders, a prominent professor working in the field of bioanalytical science. His statement pretty much summed up our client’s EB-1A petition—we demonstrated to the USCIS that our client’s work is essential to the United States and that halting his work in the country would be detrimental to the nation. This is how we went about doing it:

  • We urged our client to gather recommendation letters. Besides the one mentioned above, our client returned with three other letters, all of which were contributed by other influential members of the field.
  • We noted our client’s doctorate in environmental toxicology and demonstrated that he is well-armed with the skills needed to continue carrying out essential research that focuses on using bioanalytical skills and mass spectrometry to investigate cancer biology and to develop antiviral drugs.
  • Our client’s peer review experience, citation count, and publication record were also noted. At the time of filing, these figures stood at 19 peer reviews, over 650 citations, and 18 published scientific articles.

Because we were able to prove that our client’s work has various applications (particularly when it comes to novel mass spectrometry for evaluating and classifying DNA damage in cells and gaining insight on drug metabolism, pharmacokinetics, and the pharmacology of antiviral drugs used for treating hepatitis and HIV), the USCIS was persuaded to approve his EB-1A petition. We congratulate our client and thank him for working with our law firm. All that stands in his way towards permanent residency is the I-485 application, and we wish him the best with it.
