Case Summary:

A California-based postdoctoral researcher hired North America Immigration Law Group (NAILG) to help him obtain an EB-1A petition approval. With expertise in the field of mechanical engineering, his strong background in microfluidics and microscale heat transfer led to the development of energy efficient heat transfer devices.  One of his most praiseworthy contributions to date is the development of a novel edge detection technique for multiphase flow analysis. Furthermore, our client’s research addresses some of the United States’ most pressing issues in understanding the characteristics of microscale heat transfer and multiphase reactor interfaces.

An important element of our client’s EB-1A petition was the presentation of recommendation letters signed by other influential members of the scientific community. These 6 letters were contributed by experts in the mechanical engineering field and they attested to the importance and significance of our client’s contributions. According to one of these letters: “[Client] has surpassed many of his peers in his research area. His consistent publications in high-quality, peer-reviewed journals are truly exceptional compared to others in his field and have been extensively cited by peer scientists…”. There is no doubt that these recommenders helped the USCIS to understand the relevance of our client’s work to the field.

Responding to the RFE:

Despite our best efforts, the USCIS sent a Request for Evidence (RFE) just 15 days after our client elected to upgrade his EB1A case to Premium Processing. As part of our services, our professional team responded to the RFE in a quick and effective manner. Although the RFE significantly lengthened the overall adjudication timeline, our team’s vigorous follow-up of the case led to its approval. This EB-1A petition approval underscores NAILG’s outstanding record of helping our clients accomplish their goal of obtaining I-140 petition approval.
