Case Summary:

When a postdoctoral fellow in Tennessee sought the assistance of North America Immigration Law Group (NAILG) to file an EB-1A (Alien of Extraordinary Ability) petition, our team approached the case in a very meticulous manner. The first step we took in building a strong and watertight case was to analyze our client’s credentials. Once we were convinced that our client –– a doctoral degree holder from China –– was a good candidate for this stringent visa category, we started collecting relevant information regarding her research career. The following points were noted by our team:

  1. Our client’s specialized research in molecular biology is focused on the DNA damage response in cancer, gene-environment interactions in cancer susceptibility, and the signaling pathways that underlie adverse drug reactions. Her research helps the scientific community in the United States develop a deeper understand of carcinogenesis and pharmaceutical side effects. Our client’s research also aids the development of novel treatments for prostate cancer and better screening tools for lung cancer susceptibility. Considering that therapeutic-related morbidity and mortality are a major public health problem in the US, allowing our client to continue her research unimpeded will definitely benefit the nation. Our aim was to highlight these benefits to the USCIS and thereby secure her EB1A approval.
  2. At the time of filing, our client’s published work, including 14 peer-reviewed scientific articles in high impact journals, had garnered 90 citations. Furthermore, our client’s standing as a molecular biologist of great expertise and knowledge was reflected in the 25 peer reviews she had conducted. To top it all off, she had served on the editorial board of 1 journal.
  3. In order to fortify our client’s EB1A petition, we suggested that she gather recommendation letters from other experts in the field. Taken from one of the 6 recommendation letters she collected, this statement made by an eminent professor is noteworthy: “I firmly believe that the research community could not have progressed as far as it has in our understanding of oncology, specifically lung cancer risk factors, without [Client’s] work, and we continue to rely upon her talents and expertise today. [Client’s] lengthy list of previous achievements designate her as a researcher of unparalleled skill, and I genuinely look forward to her certain future successes.” Similar words of support contained in the other 5 letters were a sure indication of the value and merit of our client’s work.

After assembling a well thought-out EB-1A petition, we filed it on her behalf. Just 10 days after we filed the petition, our client instructed us to upgrade it to Premium Processing (PP). PP is a paid option offered by the USCIS which speeds up the adjudication timeline so that cases are processed within 15 days. Our client’s decision to upgrade her case to PP enabled a quick response and her EB1A was approved just 8 days after the upgrade. Our team would like to extend our congratulations to our client for securing EB1A petition approval. We have given her access to our comprehensive D.I.Y Packet to help her with the I-485 application, and we wish her well as she adjusts her status for permanent residence.
