Case Summary:

The USCIS considered it befitting to acknowledge the years of biomedical engineering expertise possessed by a Taiwanese research fellow by granting him EB-2 NIW (National Interest Waiver) approval. They were convinced that his work— focused on designing optical devices with neurosurgical and cancer research applications and in standardizing biomedical devices— is of great importance to the United States.

North America Immigration Law Group’s meticulous approach to this case started with the verification of our client credentials to determine EB-2 NIW suitability. On being assured that his credentials were a good fit for this visa category, we proceeded with the formalities of counter signing an attorney-client agreement. In preparing our client’s NIW petition, we noted several important points regarding his laudable research career:

– Our client had secured a Ph.D. in Bioengineering, which armed him with the practical and theoretical knowhow to conduct impactful research. After careful perusal of his achievements, our team convinced the USCIS that our client’s work directly contributes to the enhancement of imaging tools used for therapeutics, diagnostics, and clinical research in the United States.

– Our client’s scholarly contributions were also significant and comprised of 22 peer-reviewed publications in various journals and international conferences. The fact that 8 of these published articles were first authored further pointed to our client’s caliber as a researcher. Moreover, his published articles had collectively garnered 180 citations at the time of filing.

– Incorporating dependent and independent recommendation letters in the petition dossier is a standard practice of our firm as these letters undoubtedly influence the outcome of I-140 petitions. To this end, we advised our client to collect recommendation letters from other biomedical engineering experts. The 4 recommendation letters he collected bolstered his case, as is evidenced by the words of appreciation included in one of these letters:

“When I consider the brightest minds in biomedical engineering, I include [Client] on that short list. He has proven time and time again that his original research is at the forefront of the field, and it answers some of our most pressing questions.”

After obtaining all the relevant documents, we filed a very concise and comprehensive NIW petition which was approved in a little over 4 months (the average amount of time the USCIS spends adjudicating I-140 petitions is between 4-9 months).
