Case Summary:

A postdoctoral associate from India hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions for her: one under EB-1A (Alien of Extraordinary Ability) and another under EB-2 NIW (National Interest Waiver). It is not unusual to file two petitions as it increases the odds of obtaining approval. In this case, our client was fortunate enough to have both petitions approved.

Building two cases:

So what does it take to build two I-140 cases for one client? Despite being two different petition categories, some of the information contained in both the NIW and EB1A presentations overlapped. For instance, we used the same set of six recommendation letters to strengthen both petitions. As a taste of what these letters are all about, this is a statement made by one of the recommenders: “It is easy to see the knowledge and skill which she possesses in this realm, as she is clearly able to orchestrate research which not only offers new information to the academic community, but also establishes tangible ways for combustion researchers and industry operators to modify engine configurations appropriately for purposes of critical environmental remediation efforts.”

Besides recommendation letters, both our client’s NIW and EB1A petitions also contained data on her 6 publications that had gathered 132 citations at the time of filing as well as the 20 times she had conducted peer reviews for a handful of scientific journals. On top of that, we highlighted her work on high pressure and high temperature experiments on aviation fuel components and modeling the chemical kinetics and combustion features of common fuels, such as jet fuels, natural gas, and diesel fuel.

We congratulate our client for obtaining two petition approvals, and we thank her for retaining our I-485 services. At the time of writing, we had already filed I-485 applications for both our client and her dependent, and we join them as they await good news from the USCIS.
