Case Summary:

EB-1A (Alien of Extraordinary Ability) is generally considered a very stringent visa category that requires solid documented evidence to establish the petitioner’s sustained national or international acclaim and extraordinary ability in their chosen field. When North America Immigration Law Group (NAILG) was approached by our client to help him with EB1A filing, we had to determine if his credentials were strong enough to build a good case. Once we were convinced that we could help him obtain petition approval, we commenced the process of assembling an effective EB1A petition which contained the following particulars:

– We meticulously highlighted our client’s notable scholarly contributions: 16 peer-reviewed scientific articles published in well-established journals which had already garnered 143 citations at the time of filing. This was a sure indicator of how our client’s research efforts were acknowledged by his peers.

– Our client had conducted 30 peer reviews for established journals in the field of computer engineering. Moreover, he had served as the associate editor of an international conference as well as for two high impact journals.

– In order to highlight our client’s superior standing as a researcher, we encouraged him to collect recommendation letters from other top-level computer engineering experts. Of the 6 letters he had collected, the following statement made by a prominent professor is especially noteworthy: “The quality of the work that [Client] has completed to date clearly distinguishes him as one of the premier researchers in this field. He possesses a set of skills that would be extremely difficult to replace if his career were interrupted. For that reason, his work in the United States must be allowed to continue.”

The recommending experts praised our client’s accomplishments in the field of computer science. They also shed light on the fact that his research addresses some of United States’ most pressing issues in understanding how to improve automatic diagnostic methods, robotic navigation technologies, and localization and mapping techniques. Most importantly, they highlighted that our client’s continued presence in the US will lead to the development of safer and more effective robotic devices, which positively impact several American industries, including healthcare and automobile.

Just 20 days after filing the EB1A petition, our client requested us to upgrade it to Premium Processing (PP). PP is a paid option offered by the USCIS whereby select petitioners willing to pay an additional $1,225 will have action taken on their cases within 15 days instead of 4-9 months. However, a Request for Evidence (RFE) was issued to our client not long after. We worked diligently to overcome this hurdle, and we are pleased that our client received notification of EB1A approval.
