Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: California

Approval Notice Date: April 25th, 2017

Processing Time: 13 months, 22 days

Case Summary:

A recent client of North America Immigration Law Group (NAILG) has been conducting cutting-edge studies that so far, have resulted in 5 peer-reviewed journal articles and 2 peer-reviewed conference papers. Collectively, these publications had garnered 52 citations by the time we were ready to file his EB-2 NIW (National Interest Waiver) petition.

Our client, an engineer from China, researches high-sensitive radio frequency wake up circuit and contributes to the United States’ efforts to reduce energy usage by developing more energy efficient devices. We worked diligently to prove to the USCIS that it is in the country’s best interest to let him continue his research unhindered. This point was also underscored by a prominent professor who specializes in electrical engineering. He signed a recommendation letter in support of our client’s research, and this is one of the observations he made: “…allowing [him] to continue conducting his research in the United States is instrumental to ensuring continual advancement in the field of electrical and computer engineering.” This professor was joined by several other experts in the field, all of whom contributed recommendation letters advocating for the approval of our client’s NIW petition.

By providing the USCIS ample documents in support of the meritorious nature of our client’s work, we convinced them that our client should receive the national interest waiver. Although it took longer than expected (nearly 14 months instead of the usual 4-9 months), we are nonetheless pleased that our client obtained NIW approval. We congratulate him on this win and thank him for working with us.
