Country of Origin: China

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: October 19th, 2017 (EB1A) and November 6th, 2017 (NIW)

Case Summary:

A research scientist from China hired North America Immigration Law Group (NAILG) to file two I-140 petitions for him: one EB-1A (Alien of Extraordinary Ability) and one EB-2 NIW (National Interest Waiver). It is not uncommon for petitioners to file more than one I-140 as it increases their chances of securing an approval. In this case, both our client’s petitions were approved, bringing him one large step closer to green card success.

Building two winning cases:

We filed our client’s NIW petition first and two months later, his EB1A followed suit. As we filed the EB1A petition with Premium Processing (PP), our client received notification of case approval merely 13 days later. In addition to that, his NIW petition was approved less than a month later (which made it only 3 months in total). So what did both petition dossiers contain? Although NIW and EB1A are two different I-140 categories held up by distinct criteria, several key points of both our client’s petitions overlapped. For instance, both petitions contained data on the 162 citations gathered from our client’s 9 publications. They also highlighted the 11 times he assessed the work of his peers. Additionally, we detailed his work on the application of nanofluids in oil industry.

In a bid to strengthen both petitions, we urged our client to contact a handful of his peers for recommendation letters.  These letters supported the significance of his research not just to the field of chemical engineering but to the US as a whole. This is what one of our client’s recommenders had to say about him: “With this esteemed reputation among his peers, as well as his history of internationally-renowned research findings, [Client] is undoubtedly one of the top talents in his scientific domain.”

The approval of both our client’s I-140 petitions is an encouraging sign of the efficiency and effectiveness of our firm. We congratulate our client for coming this far in the green card process and we thank him for retaining us to file I-485 applications for himself and his dependent.
