Success Stories: NIW Petition Approved in Just over 5 Months for Postdoctoral Fellow in Texas in the Field of Chemical Engineering (based on Matter of Dhanasar)

Client’s Testimonial:

“I just received the approval of my approval of NIW petition. I wanted to thank you for the hard work that you did for this application.”

On May 18th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Chemical Engineering (Approval Notice).

General Field: Chemical Engineering

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: Iran

State of Residence at the Time of Filing: Texas

Approval Notice Date: May 18th, 2017

Processing Time: 5 months, 7 days

Case Summary:

With a Ph.D. in Chemical Engineering, there is no doubt that our client—a postdoctoral fellow from Iran—is capable of conducting impactful research in the same field. His various studies address the complex nature of nanocomposites and the relations between different molecules in a compound material, the results of which directly contribute to the study of nanomaterials and the development of new manufacturing techniques for advanced materials.

We built our client’s EB-2 NIW (National Interest Waiver) case according to the requirements set out by Matter of Dhanasar, the analytical framework for assessing eligibility for “national interest waivers”. It was imperative for us to incorporate information that highlighted the ways in which our client’s research efforts are contributing to the United States’ aerospace, transportation, and other industries implementing complex soft materials.

We also had to prove that our client is well positioned to advance the field of chemical engineering and that on balance, it would be beneficial to the United States to waive the job offer and labor certification requirements. We did just that by detailing his publication record of 8 peer-reviewed journal articles (3 of them first-authored) and 1 peer-reviewed conference article that had amassed 72 citations. Moreover, we demonstrated that his findings have caught the attention of other leading experts in the field, several of whom readily contributed recommendation letters in supports of our client’s continued stay in the country. One of the recommenders wrote: “As evidenced by his innovative research and publication success, [Client] has quickly risen to the forefront of the chemical engineering field, due in no small part to his expertise in molecular dynamic simulations of advanced materials. This has made him particularly well-suited to address contemporary challenges facing the United States infrastructure today… As such, it would certainly be difficult, if not impossible, to replace [his] expertise in the chemical engineering field.”

We congratulate our client for surpassing this important milestone in the lengthy green card process. Thanks to his approved NIW petition, he is now one step closer to green card success. We wish him well as he continues to carry out important research in the US, and we thank him for working with North America Immigration Law Group (WeGreened.com).
