Success Stories: Taiwanese Scientist in the field of Molecular Biology with Approved NIW Obtains EAD and AP after Filing I-485 Application

Client’s Testimonial:

“This is such a great news. I am more than thankful for the team’s hard work, thank you!

On March 11th, 2019, we received another EB-2 NIW (National Interest 7Waiver) approval for a Scientist in the Field of Molecular Biology(Approval Notice).

General Field: Molecular Biology

Position at the Time of Case Filing: Scientist

Country of Origin: Taiwan

State of Residence at the Time of Filing: California

Approval Notice Date: March 11th, 2019

Processing Time: 6 months, 12 days

Case Summary:

A Taiwanese Scientist in the field of molecular biology hired North America Immigration Law Group (NAILG) to file an EB-2 NIW (National Interest Waiver) petition on his behalf, and in less than 7 months, the USCIS approved his case.

In our customized NIW petition packet, our team highlighted his scientific achievements such as the 4 peer-reviewed journal articles (1 of them first-authored) in his name. We also touched on the 92 times his work was cited. Furthermore, we included detailed and organized information of his research on neurodegenerative diseases and novel targets for diagnosis and treatment. His research works of screening and characterization for antibodies in cancer and neurological disorders has indeed substantially contributed to biologics drug discovery in the US.

We have also encouraged our client to collect recommendation letters from experts familiar with his work, and this excerpt from one of the 4 recommenders described the importance of his work as follows: “The study of cellular proteins is vital for the United States because these proteins have a large role to play in the development of neurodegenerative disorders. There is a rising incidence of neurodegenerative disorders in the United States, with about 5.4 million cases of Alzheimer’s and 500,000 cases of Parkinson’s disease in the country as of 2012, the most recent year on record. These diseases are debilitating and require a great deal of expensive care. [Client] is on the front lines of research into treatment for these diseases based on cell protein control. This is why supporting his research is such a good investment for the United States, in terms of both healthcare and economics.”

Our client has also retained our firm to help him file I-485 applications for himself and his spouse. This is the second and final step in the green card process, which our client chose to undertake while his NIW petition was still pending approval. Along with the I-485 application, our client and his spouse also applied for an I-765 (application for EAD) and I-131 (application for AP) each.

Although our client has a valid non-immigrant visa status, a pending I-485 and an EAD allows him to legally remain in the United States and be employed should he lose his non-immigrant visa status. In addition, thanks to the AP, his spouse can leave and re-enter the US, which allows her to visit her family and friends back home.
