Case Summary:

A senior scientist from India approached North America Immigration Law Group ( to file an EB-1B (Outstanding Professors and Researchers) petition on his behalf. As EB-1B is an employer-sponsored visa category, our client could not self-petition and needed his employer’s full support before hiring us. Once we had everything we needed from our client and his company (such as a signed G-28 form and other relevant documents), we got to work compiling as much relevant information that we could get our hands on to build a strong EB-1B case for our client.

What makes a strong petition?

We have helped over 5,000 clients obtain I-140 petition approvals and we know a thing or two about the specific challenges encountered during the trek to the finish line as well as ways to overcome them. In this instance, the challenge lay in highlighting the value of our client’s research not just to his company but to the U.S. as a whole. We combated this by thoroughly reviewing his investigations and pinpointing his research focus: energy storage and lithium batteries with a particular focus on advanced electric vehicle batteries for environmentally friendly transportation. Moreover, we strengthened our client’s EB-1B petition by noting the 421 citations to his work and his 8 published papers.

In a show of support for our client, four expert materials scientists signed recommendation letters that briefly accounted for our client’s research projects and the value that they have for the nation. These letters were incorporated into our client’s EB-1B petition dossier and lent a hand in case approval. As an example of their importance in bolstering the petition, here is a statement taken from one of these letters: “[Client’s] work on lithium-ion batteries has brought him international renown. Keeping in mind all that he has already accomplished, [Client’s] work in this field is of the utmost importance. There is no doubt that [Client] is now one of the leaders in materials science research related to batteries. Understanding his regular contributions to the field, it is entirely reasonable to expect his success to continue for years to come.”

Request for Evidence:

Despite our meticulous efforts in presenting an airtight case to the USCIS, they issued a request for evidence (RFE) not long after the case was submitted. Even so, our legal team worked diligently to prove to the USCIS that our client’s credentials are legitimate, and they responded to the RFE promptly and effectively. Approximately 2 weeks after the USCIS issued the RFE, they took further action on our client’s case and granted their approval. We are pleased at the outcome and congratulate our client for getting significantly closer to a highly sought-after green card.
