On April 26th, 2016, and May 20th, 2016, respectively, we received another EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) approval for an Assistant Professor in the Field of Mechanical Engineering (Approval Notice).

Case Summary:

An assistant professor from China hired North America Immigration Law Group (WeGreened.com) to help him overcome the first hurdle of the green card process (the I-140 petition). To increase his chances of getting a petition approval, he wanted us to file two I-140 petitions: one under EB-1A (Alien of Extraordinary Ability) and another under EB-2 NIW (National Interest Waiver). Although our client was fortunate enough to get both his petitions approved less than 2 weeks apart, we are particularly pleased about the approval of his EB-1A petition. This allows him to proceed with the next step of the green card process (filing an I-485 application) without needing to wait several years for his priority date to become current.

Putting together two I-140 petitions:

As EB1A and NIW are two different visa categories, we had to put together two different petition packets for our client. Even so, several details overlapped:

  1. Recommendation letters: We urged our client to contact other influential mechanical engineers for recommendation letters. As part of our comprehensive services, we helped him select these recommenders by making sure that they were familiar with his work and/or had worked with him. Value of our client’s work to the U.S.: With a Ph.D. in Engineering Mechanics and Mechanical Engineering, we established that our client is equipped with the skills needed to carry out impactful research that benefits the United States.
