“Thanks so much for your efforts in my case. Finally, my case is approved and I appreciate your contribution in my case.”
General Field: Materials Science
Position at the Time of Case Filing: Postdoctoral Research Associate
Country of Origin: China
State of Residence at the Time of Filing: Washington
Approval Notice Date: January 1st, 2018
Processing Time: 98 Days (Premium Processing Requested)
Exactly 98 days after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition for a well-known postdoctoral research associate from China, he received notification of case approval. Although our client only waited 98 days for his case to be approved, it was not smooth sailing the entire time—less than a month after the case was filed, it received a Request for Evidence.
What is a Request for Evidence (RFE)?
According to the USCIS website, an RFE is “made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant’s eligibility for the benefit sought.” The RFE they sent us indicated what information they needed to fully evaluate our client’s petition. Our team worked effectively to put together and submit an RFE response package before the deadline. Thanks to our meticulous efforts, the USCIS subsequently approved our client’s EB1A petition.
What did our client’s EB1A petition dossier contain?
Besides details of his work on experimental metallurgy, numerical simulation, automotive engineering, and solid mechanisms, our client’s EB1A petition packet also listed the 101 times his work was cited, his 17 published articles, and the impressive 73 times he had reviewed and judged the work of other researchers working in the field of materials science. Overall, the I-140 petition packet which we put together highlighted the significance of our client’s research, particularly when it comes to understanding how to produce better performing materials for automobiles and other American industries.
In a bid to further fortify our client’s EB1A petition dossier, we urged him to collect recommendation letters from a handful of other influential materials scientists. Six of his peers agreed to lend their support, one of whom stated the following in his recommendation letter: “To summarize, the United States can ill afford to lose a researcher of [Client’s] caliber, especially considering the immediate value of his work to U.S. energy interests. […] His current and future research certainly presents an invaluable opportunity for the United States of America.”
We congratulate our client for securing EB1A petition approval, and we wish him the best as he continues to advance the field of materials science.
