On April 1st, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for an Application Engineer in the Field of Electrical Engineering (Approval Notice).

General Field: Electrical Engineering

Position at the Time of Case Filing: Application Engineer

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: California

Approval Notice Date: April 1st, 2016

Processing Time: 8 Days (Premium Processing Requested)

Case Summary:

Not long ago, North America Immigration Law Group ( helped an application engineer from China get his EB-1A (Alien of Extraordinary Ability) petition approved. Nebraska Service Center only spent 8 days reviewing his petition before they issued an approval notice. The reason for such rapid adjudication was due to Premium Processing (PP). This is a paid option offered by the USCIS to certain visa categories (EB-1A is one of them). By paying an additional $1,225, our client was eligible to receive news regarding his case within 15 days instead of 4-9 months.

Our client, who has a Ph.D. in Electrical Engineering, had many other impressive achievements in the bag, most of which were detailed in his EB-1A petition. For instance, we noted his 9 peer-reviewed scientific articles and 7 conference papers, the 125 citations to his name, and the 33 times he assessed the work of other electrical engineers for prominent scientific journals. We also detailed his research on flexible and deformable electronics, and MicoElectroMechanical Systems (MEMS)-based sensors and transducers. After carefully reviewing his past and current projects, we established that his findings are essential to the continued development of the American electronic industry.

Although we already had sufficient information to present a strong case to the USCIS, we wanted to be sure that our case was airtight. Thus, we prompted our client to gather recommendation letters from several other influential researchers in the field. The six letters that he managed to collect furnished the USCIS with further proof that our client is an important member of the scientific community and that his work progresses the research of many other scientists. As an example of what these recommendation letters contained, here is an excerpt from one of them: “Given [Client’s] work on the development and utilization of flexible electronics for microwave and antenna applications, it is clear that [Client] has taken a leading role in providing the major findings necessary to advance the field of electrical engineering research.”

Favorable Outcome:

We are pleased that our diligent efforts in compiling and presenting our client’s credentials to the USCIS resulted in the best possible outcome: an EB-1A petition approval. We congratulate our client on this accomplishment and thank him for choosing to work with our law firm.
