A research fellow based in Massachusetts recently received EB-1A (Alien of Extraordinary Ability) approval with assistance from North America Immigration Law Group (NAILG). One of the factors that convinced us he qualified for EB1A had to do with the highly pertinent nature of his research that addresses some of the United States’ most pressing concerns in understanding the treatment of major cancers. By applying concepts from molecular and cellular biology, our client is progressing our understanding of molecular aspects of cancer progression, identifying new therapeutic targets, and validating pharmaceuticals for certain cancers.
Building an EB1A case:
As part of our services, we collected a wealth of information related to our client’s contributions to the field of cancer biology. For instance, we detailed his 14 peer-reviewed scientific articles published in several prominent journals. We also listed the 148 times his work had been cited at the time of filing the petition. Furthermore, he had performed 29 paper reviews for various scientific journals, which proved that his opinions and ideas are crucial to the scientific community.
That our client has been working rigorously to progress the field was corroborated by other influential researchers, one of whom hailed our client’s “unparalleled level of expertise” that made “him an irreplaceable member of the cancer biology field”. A study carried out by our client was lauded by one of his recommenders, who wrote: “… [Client] has facilitated scientific understanding of breast cancer formation, contributing to efforts to develop more effective diagnostic methods and treatments.”
By incorporating all of the above details and additional evidence in the petition packet, we built and filed a strong EB1A case for our client. Roughly 3.5 months after filing, he opted to upgrade his case to Premium Processing (PP), which guaranteed action would be taken on it within 15 days. Sure enough, the USCIS adjudicated his petition and approved it 10 days after the PP upgrade. NAILG continues to represent our client and his dependent in the I-485 application, the approval of which will confirm their status as permanent residents of the United States.
