A visiting fermentation scientist from India hired North America Immigration Law Group (NAILG) to help her and her spouse obtain their green cards. There are two steps in the process: filing an I-140 petition and an I-485 application. In this case, we advised our client to file two I-140 petitions to increase her chances of obtaining petition approval. After carefully considering her options, we filed our client’s petitions under EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Wavier). Nearly 6 months after her EB1A was filed, she received notification of case approval. At the time of writing, we are still waiting to hear back regarding her NIW petition.
What did the winning EB1A petition contain?
Among other things, we listed the 5 peer-reviewed scientific articles and one conference article published by our client. We also listed the 117 times her work was cited by dependent and independent researchers around the world. Furthermore, we listed our client’s research on the production and optimization of processes via mammalian and microbial cell cultures to generate novel products. Not only did we demonstrate to the USCIS that our client’s findings are essential to the overall advancement of the field of bioprocess engineering, we also determined that she is an asset to the United States.
Several experts in the field discussed our client’s background and accomplishments in their recommendation letters, all of which were incorporated into our client’s EB1A petition packet. According to one of them: “[Client] is a vital member of the bioengineering research community. Her many achievements are a testament to her exceptional talents and unique expertise within flow dynamics and other topics central to bioengineering.”
Additional evidence such as our client’s doctoral degree and summaries of her research projects were also presented to the USCIS to strengthen her case. Overall, we are pleased that our meticulous efforts paved the way for EB1A case approval, and we thank our client for choosing our law firm to help her navigate the complex green card process.
We are pleased to announce that North America Immigration Law Group has so far received over 7,500 EB-1A, EB-1B and EB-2 NIW approval notices. In 2015 and 2016, the approval rate is 97.9% for cases using our "Approval or Refund®" (money back guarantee) service and 96.9% for all cases.
As one of the leading U.S. immigration law firms providing the most comprehensive services focusing on EB-1/NIW petitions, we are proud to maintain our high approval rates with a large volume of approved cases.
Our staff keeps close track of the latest immigration trends and regulations of USCIS (U.S. Citizenship and Immigration Services), decisions of AAO (Administrative Appeal Office) and judicial review opinions.
