At the start of the year, a talented postdoctoral fellow from India hired North America Immigration Law Group to file an EB-1A (Alien of Extraordinary Ability) petition on his behalf. He knew of our excellent approval rates and wanted to give himself the best chance of getting closer to a green card. We did not let him down—our meticulous presentation of his strong credentials paved the way for case approval. As the cherry on top of the cake, the USCIS only spent 3 days adjudicating our client’s petition before granting their approval. The accelerated adjudication was largely due to Premium Processing, a paid option that allows petitioners to receive action on their case within 15 days instead of 4-9 months.
We were tasked with putting together a strong EB-1A petition packet to convince the USCIS that our client should continue his research unhindered in the United States. We had to demonstrate his position of leadership in the field of molecular biology and highlight his various professional accomplishments. It took us exactly 3 months to prepare our client’s petition packet before we submitted it to the USCIS. Here are some of the things it contained:
- Record of achievement: We noted everything from the number of times our client conducted peer reviews to the amount of citations his work had amassed. At the time of filing, our client had already reviewed 18 journal articles and 52 abstracts, and his 8 publications had collected over 600 citations.
- Recommendation letters: We needed the support of our client’s peers to increase our chances of obtaining petition approval. As with all our clients, we carefully reviewed a list of professionals working in the field and helped our client select a handful who could serve as strong recommenders. The four experts we selected were composed of independent and dependent recommenders, and when approached by our client, they gladly agreed to lend their support. Here is what one of them had to say about our client: “[Client’s] discoveries and observations have proven essential for his field, and his record of achievement is a sound indicator of his continued success in the area of epigenetics and genomics. [Client] is certainly one of the most accomplished individuals in this area, and the sustained advancement of the field is heavily dependent on his continued research.”
- Supporting material: We noted our client’s Ph.D. in Medical Biochemistry and established that he is armed with the theoretical know-how to continuously conduct practical research in his field. We also accounted for his work on the design and development of therapeutics for the treatment of cancer and Alzheimer’s disease, and concluded that the U.S. medical sector gains aplenty from his findings.
We congratulate our client on this milestone and wish him well with his I-485 application. North America Immigration Law Group thanks him for choosing us to represent his EB-1A case, and we wish him the best with his continued research efforts.
