North America Immigration Law Group (WeGreened.com) was hired by a Chinese engineer to file two I-140 petitions on his behalf: EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver). At the time of writing, our client had already received his EB-1A petition approval and was waiting for the USCIS to take action on his EB-2 NIW petition. Filing two petitions is not unusual as it increases one’s chances of securing an approval. In this case, we are very pleased that our client received an EB-1A approval as it allows him to file an I-485 application without waiting several years for his priority date to become current.
Obtaining an EB-1A petition approval:
As EB-1A is upheld by a very high standard of law, not everyone possesses the credentials to file an I-140 under this visa category. Our client is undoubtedly the cream of the crop in his field of electrical engineering and our job was to prove it to the USCIS. These are some of the points that we focused on in preparing his EB-1A petition packet:
- We noted his citation count, which at the time of filing stood at 133 citations. - As we needed to prove to the USCIS that our client is an asset to the nation, we had to document his research on semiconductor devices. Thanks to the research summary that our client provided us, we concluded that his work enhances our understanding of how to improve the performance of the optoelectronic and microelectronic devices.
Overall, the USCIS only spent 17 days adjudicating our client’s petition before granting their approval. The accelerated timeline is largely thanks to Premium Processing (PP)—an add-on service that our client opted for 9 days after his case was initially filed. Just 8 days after his EB-1A was upgraded to PP, he received news that his case had been approved. We congratulate our client on this joyous occasion and wish him the best with the final step of the green card process: filing an I-485 application.
