Late last year, a postdoctoral scientist immersed in the field of virology approached us for help with the complex green card process. During the free evaluation stage, we learned that he was interested in filing his I-140 petition under the employer-petitioned EB-1B (Outstanding Professors and Researchers) visa category. Unlike self-petitioned visa categories (such as EB-1A and EB-2 NIW), petitioners cannot proceed with EB-1B without their employer’s express support. In this case, our client convinced his employer (an independent biomedical research institute) to act as the petitioner of his I-140. After we collected the relevant paperwork from his employer, we proceeded to build a strong EB-1B case on his behalf.
What did the EB-1B petition packet contain?
Amongst other things, our client’s EB-1B petition dossier was composed of his citation count (212 citations) and publication record (9 published articles) at the time of filing. It also contained six recommendation letters that advocated for the approval of his EB-1B petition. For instance, one of our client’s recommenders stated this: “It would clearly be detrimental to the United States to withhold permanent residency from [Client]. The United States would be losing the talents of a virologist who is known around the world […] I am certain that [Client] should be supported by the United States […].” These were contributed by other experts in the field of virology, and they played an important role in persuading the USCIS to approve our client’s EB-1B petition.
Not to be left out was our client’s academic and professional achievements. He obtained his M.Sc. and Ph.D. from two well-known institutes in his birth country of India. These advanced degrees proved that he is more than capable of carrying out impactful virology-related fieldwork. Additionally, our client’s successful research efforts on screening molecules to find treatments for infectious diseases prove his mettle as a top researcher. We determined that because his findings advance new drug therapies, they play an important role in the overall progress of the American pharmaceutical industry.
Taking the final step:
Not long after our client found out that his EB-1B petition was approved, he retained our services to help him with his I-485 application. This is the final step in the two-part green card process, meaning that once his application is approved, he will become a proud green card holder. We are pleased to be a part of our client’s journey to permanent residence and we join him as he waits for the USCIS to take action on his I-485.
