Case Summary:

Roughly 3 months after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a Chinese research investigator, NSC approved his case. Our client elected to upgrade his case to Premium Processing, which greatly reduced the overall wait time for a decision (it usually takes the USCIS between 4-9 months to adjudicate I-140 petitions).

With a Ph.D. in Materials Science and Engineering, our client is proficient in carrying out research in the field of biomedical engineering. His studies have propelled him to the top of the field and he has sustained international/national influence. In order to prove this to the USCIS, we demonstrated that he met at least 3 of the 10 evidentiary criteria for EB1A. The 3 criteria we focused on were (1) original contributions, (2) authorship, and (3) judge the work of others. At the time of filing, our client’s work had already collected 173 citations, he had authored and published 13 scientific articles and 2 book chapters, and he had judged the work of his peers on 50 occasions.

Besides that, we urged our client to gather external support from his peers in the form of recommendation letters. These letters backed up our arguments in the EB1A petition and substantially proved that our client’s efforts in developing biomaterials and tissue engineering strategies are important to the US.
