Case Summary:

An R&D director from China hired North America Immigration Law Group (NAILG) to help him get one step closer to a green card. He knew that we provided comprehensive advice to our clients such as the best timing to file the case and the best category. Our firm also has firsthand information regarding any changes the USCIS makes in adjudicating cases.

Before we took on his case, we carefully evaluated his credentials and asked him questions related to his work in the field of condensed matter physics. After we established that we could build a solid EB-1A (Alien of Extraordinary Ability) case, we countersigned the retainer agreement and got to work.

One of the first things we did was to help our client select recommenders. We made sure that the shortlisted candidates were expert physicists who saw great value in our client’s work. We then urged our client to reach out to them and ask for recommendation letters.  Six experts agreed to lend their support, one of whom had this to say about our client’s findings: “[Client’s] process has not only great academic value, but immediate and important market value to multiple industries in the United States. […] Given the wide-ranging implications of [Client’s] process, it is clear that his work is of great value to the United States and should continue unhindered.”

Besides recommendation letters, our client’s well-crafted EB1A petition dossier contained a wide range of specific information pertaining to his work. Further, we noted the 142 times our client’s 11 publications were cited as well as the nearly two dozen times he assessed the work of his peers. We worked diligently to prove to the USCIS that our client is an extraordinary researcher whose work addresses some of the United States’ most pressing issues in condensed matter physics.

Despite our best efforts, the USCIS issued a Request for Evidence (RFE) not long after we filed the EB1A petition. Our team efficiently put together a strong response to the RFE, which subsequently led to case approval. We congratulate our client for securing EB1A petition approval, and we wish him the best as he adjusts his status for permanent residence.
