Case Summary:

With an M.S. in Molecular and Cellular Biology and many years of experience carrying out research in the field of neuroscience, our client seemed like a suitable candidate for the national interest waiver. North America Immigration Law Group (NAILG) spent several months building the EB-2 NIW (National Interest Waiver) case for our client, and by the time we were ready to file it, we had compiled a wealth of information pertaining to her research.

The information we gathered was clearly presented to the USCIS, with the end goal of proving that our client’s work is of substantial merit and national importance, that she is well-positioned to advance the field of neuroscience, and that it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.   • Based on what we learned, we demonstrated to the USCIS that our client’s research efforts directly contribute to collective understanding of how sensory organs develop and neuronal connectivity in the human brain. Additionally, we proved that her work benefits tens of millions of Americans suffering from varying degrees of hearing loss.

Our client’s NIW petition also contained six letters of recommendation signed by other prominent experts in the field. These letters served as evidence that other neuroscientists agree with our claims regarding the importance of our client’s research. According to one of them: “With her history of innovating solutions to longstanding challenges in the analysis of neural groups, [Client] is now poised to continue transforming the capabilities of researchers working with sensory organs.”

Although our client’s NIW petition was issued a Request for Evidence (RFE), our team promptly and effectively responded to it, which led to subsequent petition approval. We are glad that our diligent efforts paid off and that our client obtained the national interest waiver.
