General Field: Clinical Medicine

Position at the Time of Case Filing: Fellow

Country of Origin: India

Approval Notice Date: September 13th, 2019

Processing Time: 5 months, 29 days

Case Summary:

Less than 6 months after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition for an Indian Fellow in the field of Clinical Medicine, the USCIS approved his case. Our customized petition letter played an important role in convincing the USCIS that our client qualifies for a national interest waiver under the analytical framework set forth in Matter of Dhanasar.

We placed the focus of the petition on our client’s specialized research pertaining to the evaluation of hematological malignancies like amyloidosis, leukemia and novel tumor marker based therapies in hematology and oncology. His research also has broad implications for the field. His research is of value to the United States because he limits the chance of misdiagnosis in certain diseases.

We submitted evidence of 8 peer-reviewed journal articles which gathered 12 citations. Also, we included 6 recommendation letters signed by noted experts in the field to further support the petition. From our experience of securing nearly 15,000 I-140 approvals, we believe that these recommendation letters are critical to the petition approval because they provided the USCIS with a different perspective to observe our client’s standing in the scientific community. For instance, this is what one of his recommenders noted in the letter: “[Client] has benefited his field and his patients through his dedication to discovering the answers to complex and rare medical problems, and his education, experience, and medical acumen allow him to do this…[Client]’s practice of rigorously investigating and diagnosing such rare diseases is a necessary example of the diagnostic rigor that must be enforced all over the world in order to catch and treat these rare diseases for those whose lives are affected by them.”

We are pleased to see that our hard work paid off. We congratulate our client for obtaining the NIW approval and we also thank him for retaining our I-485 service to help him adjust his status in the United States.
