On April 19th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Senior Engineer in the Field of Materials Science (Approval Notice).

General Field: Materials Science

Position at the Time of Case Filing: Senior Engineer

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: New York

Approval Notice Date: April 19th, 2016

Processing Time: 6 Days (Premium Processing Requested)

Case Summary:

Just 6 days after we filed an EB-1A (Alien of Extraordinary Ability) petition for our client, he received notification of case approval. Our client, a senior engineer from India, hired North America Immigration Law Group ( to help him attain petition approval, and we did just that. Accelerated adjudication was largely thanks to Premium Processing, a paid option offered by the USCIS. Petitioners have to submit an I-907 form and pay the USCIS an additional $1,225 to enjoy rapid processing (within 15 days instead of 4-9 months).

Submitting a convincing EB-1A petition:

The thing about EB-1A is that it is upheld by a very high standard of law. We had to prove to the USCIS that our client met at least 3 out of their 10 requirements. We focused on his publication record, significant contributions, and experience judging the work of others. In terms of our client’s publication record, he had 13 scientific articles, 12 conference papers, and 1 book chapter to his name. As for significant contributions, we used Google Scholar and other relevant sites to establish that his work had gathered 205 citations at the time of filing. Finally, we demonstrated our client’s extensive experience judging the work of others by listing the 34 times he conducted peer reviews.

To further strengthen our client’s EB-1A petition, we incorporated recommendation letters provided by other leaders in the field of materials science. Besides confirming that our client is an asset to the United States, these recommenders briefly explained his research efforts on crystal growth and advanced characterization of defect structures in crystals with a view to determining their origins—with particular emphasis on semiconductor, optoelectronic, and optical crystals. Here is what one of them (a research scientist) had to say in support of our client’s EB-1A petition: “… [T]here is ample evidence that he [Client] is at the very forefront of materials science, as demonstrated by his commendable research activities, his extensive publication record, and the significant implementation of his research within the field.”

Proceeding with the next step:

The approval of our client’s EB-1A petition is a joyous time for both of us. We congratulate our client for overcoming this hurdle, and we look forward to helping him attain his green card. We recently filed an I-485 application (last step in the green card process) on his behalf, and we join him as he awaits a positive outcome.
