North America Immigration Law Group (NAILG) was approached by a Florida-based postdoctoral associate to help him file an EB-1A (Aliens of Extraordinary Ability) petition. Upon initial assessment of his academic profile, we noted that he holds a doctoral degree in biomedical engineering and has thorough experience in the field of medical imaging. In preparing our client’s EB1-A petition, we took into consideration USCIS adjudication trends at the time as well as our client’s background, achievements, and evidence of implementation to the field of medical imaging.
Based on our client’s strengths and credentials, we employed a customized legal strategy to attain EB-1A approval. For one, we noted our client’s 18 peer-reviewed scientific articles as well as the 138 times his publications were cited. We also detailed the 20 times our client had assessed the work of his peers. Further, we discussed his work on novel medical imaging techniques for oncology which contributes to further understanding on the impact of treatments on tumor progression. We persuaded the USCIS that our client’s already made significant developments involving nanoparticle-based imaging for sensitive tumor diagnosis, and the applications of his research are effectively endless in a variety of areas such as medical imaging and oncology.
As with all our clients, we advised him on the process of selecting recommenders and obtaining their testimonials. Our client returned with six signed letters, all of which strongly advocated for the approval of his EB-1A petition. According to one of his recommenders: “There are few scientists working as productively as [Client] and this is supported by his impressive publication and citation records, as well as the wide range of medical applications that his research boasts. In sum, [Client]’s research is especially relevant and useful for radiotherapy in the treatment of cancer.”
Despite waiting over 8 months—during which we raised a service request and our client contacted his congressperson— we are pleased that our client is now one step closer to his end goal of securing a green card. We congratulate him on this victory, and we thank him for choosing to work with us.
