Less than 6 months after North America Immigration Law Group (WeGreened.com) filed an I-140 EB-2 NIW (National Interest Waiver) petition for a Russian PhD candidate, the USCIS granted him case approval. With a M.D. and extensive experience in molecular biology, our client met the National Interest Waiver requirements set by Matter of Dhanasar.
We applied our firm’s vast experience to our client’s case and highlighted his work on identifying therapeutics targeting the molecular mechanisms of several serious health concerns, including cancer, kidney disease, and neurodegenerative disorders. The benefits offered by gene therapy is vital to treating genetic diseases that were previously difficult or impossible to cure, thus making our client’s research valuable to public health and clinical medicine around the world. In fact, he has communicated the findings of his extensive studies through impressive 10 peer-reviewed journal articles, and the significance of his publications is distinct based on the 74 times his work were cited and the 35 instances of peer reviews he performed.
Moreover, we made sure to incorporate letters of recommendation signed by notable experts in the field who are well-positioned to discuss the importance of our client’s influential projects within molecular biology research and how his work sustained national and international acclaim. Statements contained in two such letters confirmed our arguments:
“Lung cancer is the second most prevalent type of cancer in the United States today and the leading cause of cancer-related deaths…[Client] is a leading molecular biologist whose work has been integral in addressing this issue, and his research provides benefits to a major sector within the U.S. and helps improve the public health of its citizens”.
“This study provided critical insights into the influence of a compound’s chemical structure on its biological activities, an immensely valuable contribution to therapeutics research, and is just one example of the quality and creativity of [Client]’s work.”
Concurrent Filing of I-140 and I-485:
Applicants applying for their green card in the US have three options if their priority date is current: they can file an I-485 application after their I-140 is approved, file the I-485 while the I-140 is pending approval, or file them simultaneously. In this case, our client chose the third option to file his NIW petition and I-485 concurrently. There are several benefits to concurrent filing, one of which gives the USCIS a head start in processing his I-485 application. Additionally, he obtained his Employment Authorization Documents (EAD) and Advance Parole (AP) after filing I-765 and I-131 applications based on his I-485.
